Effective today, OSHA requires all employers with 100 or more employees that are within OSHA’s jurisdiction, to comply with the ETS2. Although the ETS2 becomes effective immediately, employers are not required to comply with the vaccine or testing requirement for all employees until January 5, 2022.
However, starting December 5, 2021, OSHA will enforce the other 9 items required under the ETS2 standard which includes the following:
1.Written policy.
2.Vaccination status of staff.
3.Paid leave.
4.Required notice of test results/diagnosis.
5.Removal of employees.
6.Required face coverings for the unvaccinated.
7.Provide information about the ETS2.
8.Reporting requirements to OSHA.
9.Maintaining records.
Each violation of the ETS2 standard requirements can carry a penalty of $13,653 up to $136,532.
